Questioned by Assistant Commonwealth Attorney Leland Hulbert

• Employed by KHSAA for 26 years.
• Stated he has contact with coaches but more with athletic directors.
• Describes KHSAA as a regulatory agency and describes how rules are put in place.
• States that until 95 degrees all heat play rules are "optional".
• 95 degrees would require a 10 minute water break every 30 minutes.
• Stated he had recently been made aware that the hygrometers has +1/-1 margin of error but that the KHSAA does not get involved with the testing of these devices.
• States "safety first" is a policy of KHSAA.
• Explains KHSAA bylaw 27, section 3 that covers the mandatory requirements coaches are required to complete. This is includes CPR training (annually), KY coaches education program, medical symposium (every 2 years) and a rules clinic (annually).
• Stated KHSAA sent out "Commissioner's Notes" in June and August that both mention heat index.
• Answered no when asked if competition should ever be put ahead of safety.

• Stated that at 94 degrees the heat play rules are optional and are just a recommendation.
• Ample amounts of water doesn't mean you stop a drill or a game.
• Stated by rule a coach would not have to schedule in any water breaks at 94 degrees.
• Stated it does not break any rules to condition athletes for 30-40 minutes.
• Explains the acclimatization and climitization requirements and restrictions.
• Stated that PRP could have held 2 four hour practices on 8-20-08 without violating any rules.
