KEY TESTIMONY:

Questioned by Commonwealth Attorney Jon Heck

• Stated he knew Max from football, went to Conway together, and they hung out in the morning.
• Testified practice started out "like a normal practice."
• Stated weight and films lasted 20-30 minutes, if I remember correctly.
• When asked if he remembered the temperature outside, replied "it was hot."
• Stated "It was a normal practice until we started running."
• He guesses the team ran about 30 gassers.
• Testified that they "Ran a lot more than normal."
• Stated Max was a person or 2 away from me while we ran.
• "As it went on, I got tired," "I got sick and threw up."
• Saw Max and Blake vomit once, once or twice.
• Ran 5-10 then took off helmet, 5-10 then took off shoulder pads off, then ran 5-10 more
• Agreed he got sick in last 1/3 of run.
• Reported when Max and Blake got sick they were not wearing equipment.
• When asked did you notice anyone else down the line that got sick, "I didn't notice."
• Testified he doesn't remember how much they ran after Max got sick.
• Stated Max collapsed 15-20 minutes after got sick.
• Testified we helped him stand up, he would go down and then run a gasser.
• Stated David Thompson was the player that helped.
• Stated "He went down, his hand kept him from going all the way down."
• Testified I ran my last one, and we held Max up.
• Stated he had a DB hold Max up while he ran the last one.
• Testified that coach told us to put him down.
• He knew David Englert to be the player that quit the team.
• Stated assistant coaches tended to max, put him in the gator and drove him to the water.
• Got sick towards the end.
• Testified he went back to locker room after team meeting.
• At the end, "a few players tried to get water, coach told them to come back."
• Stated Coach Donnally said, "he didn't run his track team like that."
• Testified "I was very tired" when he got home after practice.
• Stated he hadn't been sick like that before

Cross Examination

Questioned by Attorney Brian Butler

• Agrees when they start training people throw up
• States was fine next day, no health problems other than being tired.
• Testified he went to water before gassers.
• Stated he doesn't recall them being timed - doesn't remember
• He described Max being on both knees with his head up.
• Agrees Max collapsed after the run, then assistant coaches came.
