KEY TESTIMONY:

Questioned by Commonwealth Attorney Leland Hulbert

• Played football "just my senior year."
• Sitting under shade until time to start.
• Stated it was cool outside, as day went on, that is when the heat came.
• "We jog where ever we are going, to water"
• Testified people were walking around so coach told us we are going to run.
• Stated we not gonna stop running until somebody quits.
• Cookie, Justin crying, you could see people crying all the way down the field.
• Not normal to see people crying
• 6-10 gassers are normal, I would say we ran more than 20 gassers.
• I see people carrying him (Antonio Callaway) off the field when it was over.
• Stated he told Max not bend over, put his hands on his head.
• Testified coach blew whistle for us to go.
• Stated Justin and I were carrying Max, he was really heavy.
• He heard Coach Donnelly tell us to put him down.
• Testified that Max had white stuff around his mouth and his face was pale blue.
• Stated they got half way to shade tree, and then Donnelly told us to go to shade tree.
• Agreed once coach blew whistle then you would have to go.
• States bending down shows a sign of weakness.
• Testified when I came back he (Max) was on his hands and knees.
• He didn't go on last one, he was on hands and knees.
• He gives 100%

Cross Examination

Questioned by Attorney Alex Dathorne

• Agreed gassers are usually timed.
• Heard Coach Stinson's whistle every time.
• Stated they ran 30 minutes to 1 hour, however does remembers telling police 20-25 minutes.
• Testified Max didn't run last one, Max was on hands and knees.
• Coach Stinson said go to the shade tree.
• Coach says lay him on the ground.
• States it is J. A. that helps him with Max and that he 100% positive.
• When asked if C.S. is the other player helping him hold Max up he replied no, I am positive C. S. wasn't the one who help him hold Max.
• Don't remember Max falling down and running again.
• Stated he only took one water break.
• Recalled coolers of water being dumped on Max.
• Stated they were pouring water on him.
• Agreed that there was ice and water on field and coaches was using it to cool Max.
• Stated that C.S. did not ever pick Max up
